This is the situation that catches people out, because it is not a name problem at all. Changing your surname does nothing about the second name on the certificate, and the rules here are stricter than most people expect.

  • Jointly held shares cannot be dematerialised into a single name — where a certificate stands in the names of two people, it cannot go into a demat account held by either of them alone.
  • So a joint demat account is needed — in the same combination of names, which after a divorce is often exactly what neither party wants.
  • Transposition only changes the order — it lets the same two holders correct the sequence of names so it matches their demat account, using a transposition form alongside the dematerialisation request. It does not remove anyone.
  • Removing a holder is a transfer, not a correction — and a transfer is a different matter entirely, with its own requirements and its own tax and stamp duty consequences.

  • A name change application does not alter it — the two are different requests, so correcting your surname leaves the nomination exactly as it was.
